Terms of Use

These Terms of Use govern your use of the LustDare mobile application (the “App”), published by Marion Burgraeve EI, a French sole proprietorship (entreprise individuelle), registered at 1 rue Lorem Ipsum, 00000 Dolor, SIRET 944 468 354 00013 (“we”, “us”).

1. Acceptance

By creating an account or using the App, you accept these Terms and our Privacy Policy. If you do not accept them, do not use the App.

2. Adults only

The App is reserved for adults aged 18 or over (or the age of majority in your country if higher). By using it, you confirm that you meet this requirement. We may close any account when we have reason to believe this condition is not met.

3. The service

The App lets two consenting adults who have paired their accounts send each other “sealed” challenges: the sender chooses a category, the challenge is drawn at random by our servers and is only revealed to the sender once the receiver has confirmed doing it. Challenges are suggestive and playful; they are never explicit.

Every challenge is an invitation, never an obligation. You can pass on any challenge at any time, without having to give a reason.
Only take part in a challenge if you and your partner both freely agree to it, in a safe and legal setting, without involving any third party.
You are solely responsible for how you carry out a challenge. Never do anything dangerous, illegal, or that could expose you or others to harm or embarrassment.

5. Your account

You sign in with your e-mail address (one-time code) or, when available, with Apple or Google. Keep access to these accounts secure.
You choose a nickname visible to your partners only. It must not impersonate anyone or be offensive.
You may pair with several partners and unpair at any time; unpairing permanently deletes the shared history.
You can delete your account at any time from Settings. Deletion is immediate and permanent.

6. Custom challenges and acceptable use

Premium members can write their own challenges. You must not write or send content that is illegal, hateful, harassing, violent, involves minors, non-consenting people or third parties, or infringes anyone’s rights. We may suspend or close accounts that breach these rules.

7. Premium, subscriptions and purchases

The App is free with limits (some categories and a daily number of challenges). Premium unlocks all categories, unlimited challenges and custom challenges.
Premium is offered as a monthly or annual auto-renewable subscription, or as a one-time lifetime purchase. Prices are shown in the App before purchase.
Payment is handled by Apple (App Store) or Google (Google Play). Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, from your store account settings. Deleting the App or your account does not cancel a subscription.
Refunds are handled by Apple or Google according to their policies. You can restore previous purchases from Settings.

8. Intellectual property

The App, its design and its challenge catalogue belong to us or our licensors. You receive a personal, non-transferable right to use the App for private, non-commercial purposes. You keep the rights on the custom challenges you write and allow us to store and deliver them to your partner.

9. Availability and changes

We do our best to keep the App available but do not guarantee uninterrupted service. We may change, suspend or discontinue features. We may update these Terms; material changes will be announced in the App.

10. Liability

To the extent permitted by law, the App is provided “as is”. We are not liable for how users carry out challenges, for the content written by users, or for indirect damages. Nothing in these Terms limits liability that cannot be limited by law, nor your statutory rights as a consumer.

11. Termination

You may stop using the App and delete your account at any time. We may suspend or close an account that breaches these Terms.

12. Governing law

These Terms are governed by the laws of France. Disputes fall under the jurisdiction of the competent courts of Lorem, subject to mandatory consumer protection rules of your country of residence.
